Access to healthcare in the post-Lisbon era and the genuine enjoyment of EU citizens’ rights

Abstract

This chapter addresses the phenomenon of cross-border healthcare in the European Union (EU) in light of the constitutional framework of the Lisbon Treaty. The analysis focuses on the latest developments in the case law of the Court of Justice and the recently adopted Directive 2011/24/EU. The solutions envisaged therein are assessed against the binding nature of the Charter of fundamental rights, the fundamental status of EU citizenship, and the general principle of solidarity.
